What is comparative negligence?

 

A: “Comparative negligence” is a legal doctrine that awards an injured party damages based upon the amount of negligence. It weighs into account the negligent conduct of both the injured worker and the employer. For example, if the jury awards $500,000 in damages and a worker is found to be 25% negligent, he or she will receive $375,000 plus costs. This differs from most state laws which find that an injured party must be found to be at least 51% responsible in order to receive any damages.
